Legal Question in Employment Law in India
Hi Sir/Madam,
I need a clarification on the leave encashment policy.
An employee has not taken 12 Casual Leaves thinking that it will encash at the end of the year. (Financial year is from April 2012 to March2013).
Suppose if an employee wants to resign on April 2013 (with 2 months notice period), will he/she able to get the Leave encashment amount or not? Please clarify

Dear Sir / Madam,
(Avalahalli, Bengaluru, Karnataka)
Unless specifically mentioned in the appointment letter and the Company policy, casual leave if not availed during the financial year, lapse at the end of the financial year. The Company is liable to pay you the leave encashment earned by you during the year.
