Legal Question in Employment Law in India
Hi,
I understand that I must always abide by my appointment letter. But now, the company is aksing me to pay 2 months gross salary where as in the appointment letter it was not specifically mentioned as gross salary that has to be liued to the employer in case of not serving the notice period. So do we have any law which states that Gross/Net/Basic has to be considered while calculating the final settlement in liue to notice period if that is not mentioned clearly in the appointment letter as in my case?

It is not defined any where in law as to how the notice amount should be calculated. Therefore right now it is the discretion of the employer. However, the said issue you may take up if they sue you in the Court.
