Legal Question in Employment Law in India
Welfare Officer under Factories Act
I am working as Welfare Officer with a Limited Company.
Terms of employment are governed by the Factories Act 1947 and UP State Welfare Officers' service rules. After my appointmet pay scale was revised & notified by UP government, which is 6500-200-10500, but my employer did not revised my scale and continued to pay me gross salary of Rs. 6600 (basic Rs 3500+50%DA+30%HRA). Director of factories also directed my employer vide his letter in the year 2000 to fix my salary in the revised scale and pay the arears, dispite that my salary has not been revisied till date and as on date my basic is Rs 5597 that too after getting 5 annual increments.
What legal remedy is available in this case so that my salary is fixed according to the law and I get the arears.
Repeated request to Deputy Labor Commissioner & Deputy Director of Factories to intervien in the matter had all gone in vain.
