Legal Question in Employment Law in India

Withholding of PF and Gratuity

I was working with a company. I was relieved from my job on resignation two months before. My LTA and Leave Encashment amount has been released by the company. Now before releasing the PF and gratuity amount, the company is coming forward with some mistake done by me around 10 months before and telling me that they will not release my PF and Gratuity. Until my relieving the company had never referred this issue before me and neither there was any thing in writing to me on this issue. I am contending that the company cannot withhold my PF and gratuity amount. Kindly advise? This is disturbing me since I am in a new job and away from my earlier place.

Re: Withholding of PF and Gratuity

If something wrong done by you in the past, when you were in employment, is discovered later after you are relieved, the company may take necessary action and recover the loss, if any, suffered because of your mistake.

If you beleive that you have not done any wrong think of which you are alleged by the company, you should write a detail letter to the company and even if the company does not pay your retirement benefits you should approach the Competent authority i.e PF office and gratuity office with your grievance.
