Legal Question in Employment Law in India
I have worked with AVIVA Life Insurance Co. India Ltd, as a Sales Manager.During last three appraisals I recieved high performance grade and highest increment in Branch.I never accepted demands of boss BM( Branch Manager) and his bossCM(Cluster Manager) to log in fake recruitment of Agents and fake business, and worked with dignity. BM nad CM were not able to shunt me out of job due to high performance.Since Jan09 business for co. and branch started declining as in case of all Pvt insurers due to bad performance of ULIP and malpractices.However I maintained my record of doing ethical business. agents including mine lodged complaints against BM for embezzlment of their gifts.BM, CM kept sending offending emails to build their case,and also arranged a show cause notrice against me for charging expense on election holiday to which I replied, and Co did not persue any action but withheld toatl amount of claim.All of a sudden after 3.3years of the service co has terminated me.I learnt Development officer of LIC is covered as a workman and can file case in labour Court. Is it true. Can i also file case in labour court. Pl suggest the remedy for reinstatement and damages.
