Legal Question in Employment Law in India
I was working for a company in Bangalore and got the offer letter to join the company in native place Delhi which I accepted. I resigned my old company after serving the notice period for two months. I moved back to native place to join this new company.
HR called me one day before joining the company to sign some bond for two years which according to them was required to send me abroad for some training. I signed the bond with the same impression to go abroad for some further training. When I joined the company they asked me to work on task which was not even matching my skill set . When I asked the same to the managers they told me that I was aligned for this task only .
Bond consists of two part one self and second for the guarantor. I signed my part and guarantor was to be my father .As he was out of town he was not able to sign that bond . Guarantor documents are with me till date . As the profile and the job was not for my skill set I started looking for other company and got the offer to join other company within 1.5 months .As I have not submitted the remaining documents for the bond, company stopped my salary . I wanted to resign the company but company wanted me to pay bond amount which was almost like 1 lac for final settlement which was unfair.
They lied me about the job profile , salary structure and even asked me to sign the bond to send me abroad one day before joining the company which they never did.
I still resigned as per the process in company portal cc to my personal ID for record and joined the other company without serving the notice period .
I got several letters from the company to pay the bond amount which I was always ignoring. Its almost three years now since I left the company . Few days back I got a lawyer notice from Indore that company has appointed some retired judge as arbitrator so that final settlement can be done .
Company had not paid me the salary for one month just because bond papers were not submitted and now they are asking me for the money and sending the letters.
I feel this company has cheated me and forced me to sign the bond. I don�t know if any legal action can be taken against the company for harassment.

since u r away from indore, request the arbitrator to submit your reply from the place u r at. if you dont appear before the arbitrator, then the AT could proceed exparte and a decree could be procured against you.So write to the arbitrator breifing him your side of the facts and send it by registered AD post. Meanwhile scan your appointment contract and mail to @ [email protected] to enable us to see what does the arbitration clause state.
