Legal Question in Employment Law in India
Hi, I am working in a private Limited Company since june 2004. I have completed 5 years of service.If I leave a company now am I eligible for gratuity. Is it binding on a company to pay me the gratuity or is it upto the company whether it want to pay the gratuity?

Payment of gratuity may depend upon your rank and company rules.

Gratuity is payable after completion of 5 years of service. However it is payable only in case of
(a) superannuation, or
(b) on retirement or resignation
(c) on death or disablement due to accident or disease
