Legal Question in Employment Law in India
I have been working as a software engg in a company. Due to medical reasons I was forced to go on long term leave without pay, as the supervisor was unwilling to allow me work half day. Now they are refusing to extend my leaves, and asking me to tender my resignation. I am asking them to put that in mail, but I have a question- can they ask an employee to resign, if he is on medical leave, no matter how long? In this particular case, shouldn't the employer pay the 3 months notice period pay as its them who is asking for resignation? What are the other things which I should keep in mind before submitting my papers?
