Legal Question in Landlord & Tenant Law in India

Certificate of Residence for passport renewal (Police Clearence Certif.)

I and my wife live in house in the name of my father. He expired in 2005. He did not do the nomination. I haven't applied for change of ownership till today(will be doing it.. no hassels). My wife required the subject certificate. She applied for the same but the society office bearers refused saying that the owner of flat is not the applicant. What is the way out? The PCC will be held for lack of complete documentation and hence the passport. Please help me in getting the Cert. of Residence in this technically difficult situation.

Check if affidavit by your wife will suffice their requirement.

Residency and ownership are two different issues - you may ask the society to issue the certificate of residence and they do not, you may produce other evidence like phone bill, bank account, voter's list;

Meanwhile, you may also approach the office of R.C.S. or other local authorities for issuance of the necessary certificate on the basis of your documents.
