Legal Question in Landlord & Tenant Law in India
A expired in the house taken on rent. At the time of his demise, his wife and two unmarried sons were stating with him. Another son and daughter were married and had moved out to their ownership flats, between 7 and 14 years, earlier. Subsequently one of the unmarried sons also moved to his ownership flat along with the mother/ wife of the deceased. Both expired much later.. The other unmarried son continued to reside in the flat taken on rent by his late father and subsequently, he got married.
Q. Does he become the legal tenant of the premises?
Now the only survivors are the son and daughter who were not residing with their father, at the time of his demise and who have been owners of their own flats.. Can they claim any tenancy rights and can they claim any share in the event of the property being developed ?
