Legal Question in Landlord & Tenant Law in India
Filing a suit for eviction
I had entered into leave & license agreement, whereby the agreement was made for a period of 5 years and then extended for another 2-1/2 years. Now the agreement has expired and I served the licensee with a notice to vacate the premises but he's refused to do so. Also he's sublet the premises to his brother, which I came to know from the sales tax records filed with the excise&taxation dept. Are these records enough to prove a case of sub letting? How can I file for an eviction suit?

Re: Filing a suit for eviction
No eviction suit may be required in case of "leave and licence"; however, eviction suit is required only in case the premises are 'rented out' to tenants.
You may need to consult a local lawyer to know your exact situation based upon your documents.
