Legal Question in Landlord & Tenant Law in India
I want to know the following:
1. Can a housing society penalize its members for not attending annual general body meeting? If so, does it not go against the fundamental rights of individual members of housing society?
2. Does the housing society charge fine under the vague heading of "other charges"?
3. Can the housing society refuge to inform the members what these "other charges" mean?

If bye laws provide for penalty and under the head of " other charges", you have to challenge the bye law as bad.

Society cannot levy penalty for non attending. Society is bound to disclose Other charges else you can refuse.
