heriditory rights of commercial tenant

original tenant (personal name not firm) never done any business nor opened the office from 1979-2001 but paid rent till 1998 thru chq.

Later expired in 2001

LLord took the possession after his death,

In 2003 his son started claiming the right of tenant and filed suit for possession

jurisdiction is Maharashtra RC act ,

Can son become tenant? he was never seen office accept once-twice in 2-3 yrs

Can son be treated as tenant?

Yes, tenancy rights are inheritable and the son can lay claim.
