Legal Question in Landlord & Tenant Law in India

Hi,

We have a house in chandigarh. My mother-in-law is staying there alone some time. We have given 1 floor of the house on rent. The agreement was done on a stamp paper. The house has been given to a couple who has jobs in Chandigarh. Due to some family issues the couple have regular fights and have called police at home several times. everyon ein the locality are unhappy by their behaviour. My mother-in-law have given the tenants a notice of 1 month on 21st September which we accepted by the tenant in written. They should have moved out of the house after 1 month notice thats on 21st October. But till date they have not vacat the house rather have got a dog for his security and have started shouting at my mother. My mother-in -law is a senior citizen(69 age) and is afraid of her safely. She is a widow. The tenant is not ready to vacat the house in the context stating that the property dealer will arrange a good house then only he will leave the house. Whereas the property dealer has showed him 2-3 house already and the tenant is not ready to vacat the house. Kindly suggest a best possible way to get the house vacant in such a sceniro. Whether we should lodge a FIR against him or get in touch with a lawyer. Kindly suggest. Thanks in advance.

you need to file a suit for possession against the tenant and during the pendency of the suit, seek orders from the court restraining the tenant from handing over possession of the property to third party. the suits filed by senior citizens are disposed off early.

You have to file suit for eviction but cannot file FIR for eviction but you may file FIR for threats to your mother in law and it wil also help you to vacate the house.
