Legal Question in Landlord & Tenant Law in India

If a person take a house on rent then his wife mentally harrarsh her and he has one option to left the house and save his life. He informorned the landlord and cancell the agreement and told them to allow his wife or told her to vacant the house because he file the case for divorcee. his wife stay there and went somewhere with some household items and lock the house. she again came there and her parents makes fool to the landlord that they are shifting. she send some valueable item with her mother and brother then go with her father after some days. May be she also tranfering her items then again come back and lock the house. now she is telling to landlord that she handed over the keys to me. what shall i do now. landlord harrasing me everyday to vacant the house.

Tenant is liable to pay rent or vacate the house.

You are liable to continue paying rent till your dispute is settled with your wife.

Your wife is entitled to protection under DVA.

You should try to settle the dispute amicably with your wife and meanwhile continue paying rent to the landlord. You should also consider making some payment to your wife for her maintenance/support. this may also help you to improve your relations with her. she may be entitled to maintenance, if she is not earning.

your are required to ensure domestic peace and happiness in your own interest.
