Legal Question in Landlord & Tenant Law in India

In india, we had rented a portion of a house, which contract is expired April 2012, we had informed the tenant verbally 6 months before expiry, he said, he will vacate on expiry. We came to India from aboroad to settle down in india, we do not have other house. The tenent is not living there, he is just having office for his party.

The tenant is saying he had registered a party in Election Commission of India with my house address 2 years back, and waiting for the inspection to come (he does not know when they will come last 2 years), he will not move out till his party is registered.

We do not have other house, we just staying with a relative with school going childrens, now, he is not vacating, not reachable by phone, and closed the house.

What is the way out.

Hello,

Before Anything, Take possession of the house.

If, he is not regular visitor, then you start living there as his tenancy is already expired.

When, he will come and argue, immediately call police.

If, he comes while taking the possession immediately call police.

If , you cannot take possession then file a police complaint , then a case.

Still, it is preferable to any how take possession of your property.
