in a jscc suit in uttar pradesh lower court passed final order that defendant shall vacate the premises in one month and will pay damages @ 180/- per sq mt. per month from the date of filing the suit, in allahabad high court revision was filed where court upheld the decree for eviction but said " however the order of the trial court is modified to the extent that the petitioner will be charged damages not more than the monthly rent as presribed by law". Now the admitted rent was rs. 6400/- with the consent of the landlord. In execution the court and the landlord is interpreting the order as the damages shall be paid according to the rent list maintained by district magistrate, is this the essence of the high court order ?
