L & L or Caretaker agreement - Notarizing

I have a flat in Navi Mumbai which has been given on L & L basis to one of my relatives in September 2008. The L & L document has been entered and signed. However, it has not been registered till now. For the requirement of passport by the Licensee, the document is required to be submitted as address proof. Plesae advice, whether the existing document can be Notarized and used or I have to prepare a new document. Should it be L & L agreement or Caretaker agreement for Notarizing and will it serve the purpose for pasport. As per present rules, can L & L or Caretaker agreement be made for 22 or 33 months instead of normal 11 months? Plesae advice. I need it urgently.

Yes, the existing document may be notarized; you may not need to prepare a new document for this purpose. A document for a period exceeding 12 months may require registration; therefore, it may be better to fix the tenancy as "month to month" basis, initially for a period of 11 months.
