Legal Question in Landlord & Tenant Law in India
We are the landlord in a building since 1987. And we are good to our tenants in all terms./
But in last year one of our tenant residing there since last 60 years died , his wife also have died long back, all of sudden his brother have came from Abroad , and claiming the Tenancy rights in his name, He is not staying in INDIA, he has got NRI status, also since last 5 moths the flat is locked and closed.,
Now the NRI has came to INDIA has approached us and have given us the Cheque and ask us to issue the rent receipt in his favour, Also he is going back abroad soon and not going to stay here.
I want to ask that by what procedure should i issue him the rent receipt, or is it he legally eligible for the tenancy rights.

he is not a tenant in legal sense under Maharashtra Rent Act.
