Legal Question in Landlord & Tenant Law in India

landlord and tenant

i am tenant in chandigarh.i tendered rent in court as provisional assessment ordered by court.i paid rent twice as per orders and also filed counter claim for the refund of the rent already paid twice.then, the landlord filed another rent petition and i again tendered rent for the subsequent period.now, the landlord is claiming more subsequent rent as per rakesh wadhawans's supreme court judgement.i may mention, all the rent petitions filed by the landlord are false and frivolous, only to mislead the court in the garb od senoir citizemn.now, what is the relief for me,since, the counter claim rent is still pending in the first rent petition.the landlord wants to harass me,in way of hidden litigation charges.the landlord had failed to prove the rate of rent period of rent claimed.i do not want to tender rent in each fresh subsequent rent petition filed by the landlord.please help me.

Re: landlord and tenant

You have made a mention of Supreme Court judgement in Rakesh Wadhawan's case. As per this judgement the rent is not to be 'tendered' anymore; rather the tenant is to make payment of rent only after the court has passed an 'interim assessment order' of your liability to make payment. You may want to contact a qualified lawyer for appropriate guidance. If you do not have one, you are welcome to write me back by e-mail and I may recommend someone in the Chandigarh District Courts to help you since I also belong to Chandigarh.
