Legal Question in Landlord & Tenant Law in India

Landlord -Tenant Issues

After a verbal dispute, I am paying my rent in form of account-payee cheques for the last 3 months, but these cheques are being kept by the landlord and not encashed. Can my landlord use these cheques for any legal malpractice? Of note there is no rent deed and no rent receipt is present.

No, the landlord cannot use these cheques for any legal malpractice. But, please ensure that you have enough balance to clear all cheques not encashed by your landlord. As soon as the landlord deposits the cheques, it will be deemed that he has accepted the rent. Now, immediately, send advocates to the Landlord for issuing rent receipts for all the previous cheques along with one months advance rent. File a Declaration as Tenant suit in the competent rent court in your area against your landlord.
