I am a bank officer posted at Chandigarh. It took a house on personal lease in from Jan 2004. Period of lease was three year and rent was Rs.2900.00 per month. As per provision in our bank, I got a consent letter from Land lord containing area to be given on rent, rent amount, period of rent and other terms. No other paper was signed by landlord. On the basis of such consent, bank is paying rent directly to Landlord by way of pay order. No separate receipt is being issued by landlord. Said lease expired on Dec 2007 but fresh consent letter for extension of lease period was submitted by land lord from Feb 2007 for a period or three years at a rent of 3500.00 per month. Now my question is :

1. Whether the said consent letter can be treated as lease document?

2. Which rent act is applicable in UT Chandigarh?

3. What are the rights of renter?

till dec 2007 ur earlier agreement will be vaild

the new letter can be considered new lease

other things will be told by the local lawyers only

your further lease shall be considered a monthly lease and shall stand extended every month payment is made. Said lease of three years if not registered cannot be termed as lease and the monthly lease stands extending by your conduct to extend every time you make the payment of rents and shall be terminable on a prior notice.

not exactly .. the consent letter may not be in the require form of the lease agreement and the three years period .. it has to be registered!

Yes,if the consent letter contains all the details.Punjab rent Act is applicable and tenant has every right as a lawful tenant.
