Legal Question in Landlord & Tenant Law in India
lease
State government has given us a building on lease for 5 years through its secretary.But it is not registered and not stamped at ad valor em rate. Is this fine legally as we as tenant can not pressurise state beurocracy. Are our interests safe to the extent of unregistered lease agreement.The building's possession has been given to us 4 months back and agreed rent is being paid by us in time and will continue to be paid.

There may be no problem with such a lease. A lease by State may not require registration or stamp duty. Moreover, the State may be bound by its promise if made in writing by the competent authority.
