Leave and Licence

I am owning a flat in mumbai which i had given on leave and licence for 11 months. on completion of 11 months, since both my tenant and myself were not in town for a considerable period of time, we delayed renewing the agremment with a gap of three months. the society has now levied a penalty of Rs 100 per day till the fresh date we have renewed this L&L agreement. Are they justified to levy this penalty as the renewal of agreement was mutually delayed by us due to our absence.

The society may make a charge as per its bye-laws read with decisions of Managing Committee.

Levy of penalty depends on the bye laws of the society. If your society has a provision in the bye laws to levy such penalty then the answer is yes.
