Legal Question in Landlord & Tenant Law in India
My maternal grandfather had rented a house in the middle of the twentieth century. Later, my father transferred the tenancy in his name in 1984 after my maternal grandfather died. I have been living here ever since. The then landlord (who lived in a building adjacent to our rented house) had several children. He had died about 20 years ago. His two sons are living in their house (adjacent to our house). But, the ownership of our building has yet not been transferred to their (the landlord's sons) name. It is STILL in the name of the deceased landlord. My mother had died ten years ago. My only sister got married soon after that. My father passed away in late oct, 2010. Now, the landlord's sons are refusing to change the tenancy to my name and asking for exorbitant amount of money as monthly rent and as well as donation to change name. I sent the rent through a money order in Dec 2010, they accepted the rent. But, afterwards, they refused my rent sent via money order. Since then, that is, for last few months, I am depositing the money to the rent controller of Kolkata. I am a private tutor of Mathematics. I run my tutorial from another place by renting out that place in slot basis, without any written contract and without any rent receipt. Now, my questions are
(1) if I shift my tutorial to my rented house, can the landlord's sons do anything legally to stop me doing my tuitions here? Given the fact the house is still not in their name as the other daughters etc. of my actual (deceased) landlord had some problem with these sons?
(2) Also, can I give my payment receipt to my students with my residential address printed on the receipt? Please advise.
