Mumbai Stamp duty amnesty scheme

I had applied for the stamp duty amnesty scheme of 2004 and since last four years the stamp duty office was delaying assessing my papers on one reason or other and now finally in march 2009, they told me that they have misplaced my papers and i have reapplied for the same vide amnesty scheme of 2009. now my socirty have levied penalty of rs 100 per day from sept '08 amounting to more than rs 20,000.00 with interest for the delay in giving them my papers. are they justified? they say they have passed a resolution. pls advise.

You may be bound by the resolution unless you make your challenge before higher authorities and the same is quashed.

Well!!! as regard to the levy of fine is concerned it will be based on the bye-laws and the resolutions passed. However,if the Government departnment hs lost your papers you can report this issue to the superior authority and you can also file a writ in the high court demanding compensation for the amount paid.
