Legal Question in Landlord & Tenant Law in India
non occupancy charges
I am living in maharashtra. The latest judgement of the Supreme Court has directed all housing societies not to collect more than 10% of maintenance charges as nonoccupancy charges SLP no 7964/7965/7966. But it has also allowed the petitioner i.e. Mount Blanc Society to collect 10% of rent as NOC charges ?? Why is that so ?

Re: non occupancy charges
You will find your answer in the judgement only. Moreover, that cannot be whats and whys to a judgement of the Supreme Court more particularly about the result reached.
Are you the respondent in the said case ?
Re: non occupancy charges
Maximum NOC chgs are 10% of Service chgs and that is the Govt notification/ circular and not SC judgement. About your query the concerned judgement needs to be peruse.
Re: non occupancy charges
You are referred to judgment in which it is allowed.
