Legal Question in Landlord & Tenant Law in India

Pagadi Residence

Dear Mr./Ms. Advocate,

My Grandmother had purchased a house (Area 565 sq.ft. approx. 2BHK) 38/39 yrs ago in Mumbai, Maharashtra, India but no legal documents were ever made between her and the landlord. Our 2 generations are staying there and punctually paying rent and we get a rough acknowledgement (not a regular receipt) in Mr.X (old tenant name)

And when we wanted to transfer the Pagadi Owner is Demanding for Rs. 12 lakh.

We have the following:

1. Ration Card (from 1975) having my grand mother, myself, my wife and my daughter�s name

2. MTNL (Phone) Bill (from 1992) in the name of my father, whose name is there in another Ration Card of another residence

3. Passport (from 1990) in my name

4. PAN Card (from 1996) in my name

5. Election Card (from 2008) in the name

All of them bear the same address.

Please guide me as follows:

1. How to deal with this situation legally to transfer my room (Pagadi Owner)

2. What will be the legal amount to pay ?

3. Any personal guidance to save cost

1) Infact you can request the landlord to reduce the amount for such transfer.

2) There is nothing called legal amount in respect of the such transfer of name.

3) COnsult a local lawyer to obtain a better guidance.
