Legal Question in Landlord & Tenant Law in India

The question is under The West Bengal Premises Tenancy Act, 1997, as amended.

A tenant namely �A� died on 04-10-2010 leaving seven legal heirs behind himself. (Three sons & four daughters). �A��s wife had already died.

In accordance with the said tenancy act legal heirs sons & daughters may live only by five years after the death of the tenant namely �A�.

The questions are:

1. Under what status the landlord will receive the rent from the legal heirs as tenants or as licensee for five years.

2. The legal heirs are paying rents in the name of their late father. In these circumstances ejectment suit on the ground of necessity could be filed against them or not while no rent bill has been issued in their names.
