Rent Act

I am a registered firm,own a industrial estate,having few tenants.One of my tenant is not using his gala since last 6 months and inspite of my repeated request is also not paying me the rent.I have served a notice,thru my advocate demanding the due rent from him,but the said notice is return as the premises is close since last six months and above. do not have any alternate address of the tenant on my record,where i can send him the said notice.Now i wish to proceeds the matter in the court of small causes,for eviction of premises on default in paying rent and since i am in badly in need of the said gala to expand my business.The problem with me is that,that our firm is registered in the year 1976,and thereafter,in the year 1985,one of the partner is expired.The Registrar of firm(ROF),has not been inform about the death of the said partner.In absence of not informing the ROF about the change in the constitution of partnership,will i bw able to filled the suit against the tenants.Will my suit maintainable under law,in absence of not informing the ROF,about the change in firm on death of one of the partner.Kindly guide.

Re: Rent Act

you may inform the ROF about the reconstitution of firm.For filing a case by the company it is madatory that the firm should be registered.Your suit /case is maintainable,so go ahead.
