Legal Question in Landlord & Tenant Law in India
I am a resident in a society, and I had defaulted my prev maintenance, but gradually I have been paying and have cleared good amount and some amount is bal and int is also levied on that amt, but of late a new secretary and chairman have come and they are sitting with the sword that the total bal maintenance is be cleared immdly otherwise they will disconnect the water connection, and this is municipal water which is free water and it not chargeable so can they disconnect it... pls seek advise

1. Municipal water is not free, it is chargeable.
2. You have to pat Society dues.
3. Society cannot disconnect your water - it is a criminal offense; you can file a police complaint for that, they can do this only after obtaining order from court.
You should try to settle the matter amicably instead of inviting any litigation; The Society may debit the cost of litigation to your account;
Society has to pay water chgs from the maintenance you give to them, so water from Muncipality is not free. try to pay the dues as soon as possible otherwise the society can go for recovery proceedings with the registrar under MCS Act.
