Legal Question in Landlord & Tenant Law in India

respected sir ,madam,

we r landlord of a property in which main portion of the building is given to bata shoe company for lease/rent for 15 years .lease period had expired 2 years back but still the tenants{bata}had not handedover the keys of the premisis to us .we did not make any fresh agreement with them .we want them to vacate the premisis but they are not responding.we need the premisis for our self.few months back they vacated the premisis but did not hand over the keys to us and still sending the rent once in three months.sir please help us to get back our building from them.

File a suit for possession against BATA but before doing this send them a notice to u/s 106 of transfer of property act . I am sure they will vacate and handover the Possession to you.

in case you have not sent the notice, you may send the same and in case they do not vacate the premises, you may file a suit of possession in the court.
