Security Deposit

I took a rented a house in Bangalore India last year. As per the agreement I paid Rs.65000/ as a security deposit (10 months rent) in advance. However I am vacating the house now. Can I take the legal action against my landlord if fails to pay the security deposit to me ? What are the laws enjoyed by tenant in India ?

Hi,

he will naturally repay it if you had given him sufficient notice of you vacating as provided in the contract.

Yes you definitely are at liberty to take legal action in case the landlord fails to repay the deposit amount.

Dear Sir,

You havenot mentioned the rent payble per month but it is understandable from your question that the rent is 6500/-.

you also not mentioned whether the agreement is registered or not.

if the term is more than one year, the agreement requires compulsary registration.

Still vacating the premises is not an issue you should intimate your willingness to terminate the agreement with due written notice minimum of 15 days in advance.

Please donot hand over the possession untill the landlord refund your deposit amount.
