Legal Question in Landlord & Tenant Law in India

sir ,

10 years ago my father got a plot from j j department delhi in jahangirpuri area.my aunt has been living in that plot.i have given her, my document which was given by j j department. she wants to sold this plot without asking my father .my father lives in bihar.is it possible to sold a property like that.if she will sell this plot . what should I do. please help me.

she cannot sell the plot merely being custodian of the papers and plot unless your father has executed some documents in her favour. we need to look into the papers to further opine in the matter.

dear NO its not possible to sell the plot like this .... if you want to remove her from ur plot file eviction suit ... it will prove ur title along with it will stop her from making any sell procedure...

She cannot sell any plot to any buyer . Dear Sir / Madam,

Unless your father issues a Power of Attorney to your aunty to deal with the property in the manner she best deems fit, your aunty has no right to sell the property, since she is not the owner of the property in the first place. To be on the safe side, you should take back the title deeds of the property if they are in the possession of your aunty.
