Legal Question in Landlord & Tenant Law in India
Sir,
I am a landlord of a industrial unit in Delhi. I have given it on licence. agreement to a company. The said licence deed had expired and the licencee is not leaving the premises. We filed suit in court but they are taking grant on two grounds that first it was unregistered deed signed by the licencee too (only registered by notary) and second that a notice of 6 months is necessary for getting a industrial unit evicted. So is 6 months notice a mandatory process as in deed its clearly written that we can get land evicted at any time givihg them 3 months notice and we filed suti after 4 month period and does an unregistered deed has no value in terms of law.
Please help its really necessary
Thanks
