society asking for transfer fee of earlier owner

my sister purchased a flat in dec2006 from second party(B) of a mhada LIG colony in kurla Mumbai,she paid her transfer fee of Rs10000.through B of which she has a reciept in her name mentioning she paidRs10000 as donation to the society but ,afterwards when she went o get NOC to transfer the house i her name & pay maintenance charges,she was asked to pay tranfer fee of Rs5000 of the earlier owner/tenent(mhada) citing reason that she did not meet the soc.members before buying the house which is not true as as we went to see the soc.sec. but he was not there,still the soc. is not accepting the maintenance nor giving the NOC to transfer the name from MHADA

you can ask the society to claim from the earlier owner

Donation and transfer fee are two different things and are distinct in nature.Your sister has to pay the transfer fee if the same is mandatory in society rules.
