Legal Question in Landlord & Tenant Law in India

This is in Tamilnadu, Commercial retail property rented by way of registered lease deed for 4yrs 6mths starting from 01-Mar-06 to 31-Aug-2010. The payments have been very irregular including a few instances of dishonoured cheque payments. Rent has not been paid for the past 6 months despite continuous requests in writing and oral. I have asked him to vacate but he is not. He says he is trying to settle the outstanding amount. Though he answers the phone calls, he never comes to discuss even after repeated calls. And to me it looks like he is trying to defer meeting me or receiving any correspondences. I have not given him any legal eviction notice yet. The registered lease deed is expiring in another 19 days by 31-Aug-10. Is there any advantage for the tenant to postpone things like this until the lease deed expires? As a landlord, should I take any steps before the lease deed expires? Please help.

You have not mentioned the Advance ( Deposit) amount lying after deducting the arrears of rents due and other dues if any.

Conuslt a lawyer with the registered lease deed or its copy to take further action for eviction and or recovery of amounts due.
