I live abrod and am considering renting out my house in Delhi. Before renting it out, what can I do to make absolutely certain that the tenant does not continue to occupy the premises after the expiry of the will? I have heard of scary stories where the tenants simply don't leave and file court cases that continue for years.

Your statement is grossly incomplete and information provided is inadequate for appropriate opinion / guidance.

There is no such thing as "absolutely certain" in legal jargon. There may be no way to stop or bar the tenants from approaching a court of law except that the possession is not delivered absolute.

The safest way is to enter into rental deed get it registered duly with the registration authority ,keep specific time limit say 3months advance notice in case you want to get tenant leave the premises and keep a online banking transaction for monthly rental.Make sure that each and every point regarding to rental terms and property maintenance are specific and clear. No hidden sours.

the stories of tenant not evicting the house are True and myself have handled such cases. the tenant refuses to vacate even after expiry of lease deed and then there is a long legal battle...even till Supreme Court, before the tenant evicts the premises.

i think u need to get the lease prepared through a lawyer so he includes all the relevant clauses in order to save you from harassment later. where is your house situate.
