Legal Question in Landlord & Tenant Law in India

i am tenant in chandigarh.the landlord filed rent eviction case against me in 2006.i tendered provisional rent in court in 2007 ,alongwith counter claim that rent is being paid twice to avoid eviction.that case is pending for evidence.

the landlord again filed subsequent rent petiton in 2007.i i tendered rent as provisionally assessed on the first date of hearing in the court.the landlord again filed application for deposit of future monthly rent as per rakesh wadhawan supra supreme court judgement.i took the plea of counter clain and rent to be adjusted in future, but my counsel did not objected and the rent controller passed order for deposit of monthly rent before 10th every month ,alongwith arrears on the next date of hearing.

i filed application for deposit of arrears in treasury and rent controller passed it.

now, snice i am tendering excess rent in court, what relief i will get.

since,i had already paid in excess in first rent case, why my counsel agreed on deposit of monthly rent.the application for deposit in treasury till sept,2009 was signed in august,2009.can i deposit on this august dated application before 10th sept,2009.is there any bar or limitation period on the treasury application or i have to make new application.

In a pending court case, it may be better to proceed further in consultation with your counsel conducting your case.

If multiple applications are filed by a landlord against the tenant, an application for clubbing may be filed.
