Tenants evacuation

Hi ,

I have 2 story Flat/House in delhi. one of floor is rented out 8 yrs back to a family & there was no rental/leased document signed that time . Tenants are financially sounding .

Now due to some family reasons , I am planning to evacuate tenants & I want to utilize that floor for my family only . We have already given a 3 months deadline to my tenants . But I would like to explore all possibilities so that I can tackle future accordingly. In worst case , I may need legal help, Can you Pls advise how healthy my case is If I opt for legal help for my tenants evacuation ?? What could be time frame that legal aspects can stretch & What would be best way to evacuate my house from tenants which is actually my legal property .... I appreciate your responses .............

u need to file an eviction petition before the Rent Controller on the grounds of your bonafide requirement. nowadays the law has tilted in favour of landlords and you have a good case to call for eviction. u may call upon me at 9811284735 in case u require further guidance in delhi.

You may first ask the tenants to vacate the house for personal use and occupation.

The time frame and the legal action in Delhi also depends upon the amount of rent.

You may write back informing the rent amount fixed with the tenant and the mode of payment.

You have to file an eviction suit bofore the rent controller on the ground of reasonable requirement.

in recent times there have been very good judgements from even supreme court, in favour of the landlord so move to courts if the tenant is not evacuating
