Legal Question in Legal Ethics in India

Financial and emotional stress caused due to wrong quote from Lufthansa employee

I am a resident of California, USA. My new wife called Lufthansa's Delhi office to ask for a quote for a one-way ticket from Mumbai(BOM) to Los Angeles(LAX) for Dec 30, 2005. The intention was for me to fly to India in early December and for her and me to fly back on the same flight from BOM to LAX. A ticketing agent assisted my wife by giving a quote of Rs.31060 inclusive of all taxes (approx $740). On that basis, I asked my travel agent here in the US to book me a return ticket on Lufthansa between LAX and BOM, the return flight being the same as for the ticket quoted to my wife. This ticket cost me $1355 including taxes. For the purpose of purchasing my wife's ticket from India, I wired money to my brother in the amount of $750 (enough to cover the cost quoted to my wife by the Lufthansa agent). This transaction cost me an additional $42.95 for the transfer. On the same day, my brother called Lufthansa's Delhi office to confirm the price of the ticket. Once again, he was quoted Rs.31060 ($740). Later the same day, the ticketing agent called my wife to apologize for giving her a wrong quote, and informed her that the actual cost for the ticket would be $37000 (an extra $220). Can I sue for financial and emotional grievances?

Re: Financial and emotional stress caused due to wrong quote from Lufthansa empl

Sir,

I am sorry to say that you cannot sue the employe unless he has given something in writing. Because airlines prices tend to keep changing and its usual for the agents to keep updating their systems. Its usual practise in India that Air Ticket agents update their charges once every 3 months.
