Legal Question in Legal Ethics in India
One of my friends own an engineering college. A news paper published a news about one of their female students committing suicide inside the campus. In fact the girl who committed suicide was a student of some other institution. The news paper reported the news just besides their advertisement in its news paper without verification from their college. When they tried to express their dissent the news paper people said that they made the FIR in the police station as basis for the news. Though they reported in the news that FIR yet to be filed. Can my friend file a defamation suit on this basis if the news paper refuses to publish a denial or apology. Where the defamation suit is filed? Any other action which may be taken against the news paper?

For defamation mere publishing is not required, what is also required is the impact of such publication, that is, the manner in which defamed and the impact of such defamation
