Legal Question in Medical Malpractice in India
Dr. Khan tells Dr. Singh: A little while ago Mr. Sharma is diagnosed for very advanced stage of cancer. He may hardly live for 3 days. Medication and cure is impossible. He is a loner and has no legal heirs. He is in the business of lending money for 36% - 48% interest. Here is a chance for Dr. Singh who is badly in need of half a million rupees. In return for 100K from Dr. Singh he would hold back the diagnosis from Mr. Sharma. Dr. Singh can take from him a 600K loan safely without any need to return.
Dr. Singh agrees to this. He takes the loan the same day. As expected Mr. Sharma dies in 3 days. Dr. Singh is very happy. But he refuses to pay Dr. Khan the promised 100K.
Dr. Khan decides to go to court. Will he win?
