Legal Question in Personal Injury in India
Accident case for past 3 yrs. yet not been solved
Hi,
My brother met with a serious accident on 24th Jan 1998,in which his right leg was very badly damaged(a very serious accident). We filed a case against the vehicle owner the very same month.Since then our case has been pending.Whenever we call our lawyer regarding the case ,he gives us excuses which we don't understand. Moreover he has not given us any copies of the case filed, nor the copies of the summons send to the vehicle owner.Should we have the copies of the same? How much time will this case take once it is with the Insurance Company? Is our lawyer trying to fool us? We have paid him amount Rs.12,000/- even before the case was filed. Is it okay? Please help.

Re: Accident case for past 3 yrs. yet not been solved
Is yourcase solved by now or not do tell me ,u can mail me regarding all your queries.
whether your lawyer is making u a fool is uncertained , the notices must have been filled along with the claim petition to the driver ,owner and the insurance company of the vehicle. If your brother has got some permanent disablement due to that accident than he is entitled to get the compensation award from the driver, owner and the insurance company of the vehicle. The compensation amount depends on his age ,% of disablement, his salary and other such features.
If you still remain unsatisfied with the compensation amount in MACT than you can go for appeal in High Court within 90 days of the pronouncement of judgement.
