Legal Question in Personal Injury in India
My brother is a student of the intermediate board. His friend picked up a fight with him over a small issue, and my brother hurt him unintentionally, in defence. The guy was choking him, and unaware of the pen in his hand, my bro hit him, trying to fend himself, causing a small cut on the temple. He was hurt too, but we did not come to know of this until recently. the college he studies in, suspended him for one week, (after which they would take him back) and made our father apologise in written. now, after the suspension, they are unwilling to take him back and also insist on payement of full fees, though he attended college only for one month. They are now trying to charge him with "attempt to murder"! the families of the students have reconciled, yet the management refuses to drop the issue. How do we proceed? Please suggest a legal course of action.

you may approach the high court in writ and if the age of your brother is less than 18 years he shall be taken before the juvenile board and he cannot be terminated from the college, approach court in writ
even a criminal has a right to education. Here the case has already been settled amicably. The management cannot refuse. You have been rightly adviced to move the high court
