Legal Question in Personal Injury in India

court fee
sir ,
in a suit for malicious prosecution for rs 25 lakhs damages the court fee paid was rs 1000. nowat the argument stage the defendent advocate says the suit is undervalued and prays for dissmisal. now can the judge dismiss the suit and/ or can i take the help of section 149 ,also since the court fee is going to be very high pray to the court to pay the same befor the decree. kindly advice and also give some court rulings in this matter .

you need to pay the court fee as per the act chargeable in your state. you can avoid paying the court fee only in case u sue as an indigent person.
