Legal Question in Personal Injury in India

Facts of case:
women nine month pregnant died after complication from accident.
there was collision between police jeep(previous week jeep had been taken in for repair ) and her two wheeler as she was driving on the wrong way .
accident took place in private property which is adjacent to the road and work was going on(i.e she flew off into 12 foot deep ditch as there was no fence)
child survived and developed withe the learning disability.
she had no family and was in process of divorcing her husband who she believed to be in Dubai .
Husband uncle incurred all the medical expenses of the child. he also had to close his business.
Incident took place in the year of 2000 and case has been registered in the year of 2012.
Question are as followed:
1. whether the suit filed by husband's uncle is Maintainable
2.whether the state is liable for the accident if yes what extent
3.dose husband's uncle have right to file complaint
4.whether the negligent of the Taj Corporation cause of the accident
5.can he claim from state
6.what defenses does state have?
