Legal Question in Personal Injury in India

In a minor motor accident, injured has now filed Claim Petition against driver, owner and insurer. Accident was not reported to the Insurance company. Driver has pleaded guilty and paid fine of Rs.1000/- in Criminal case for rash and negligent driving. Under the circumstances, whether the owner of the vehicle is liable to pay compensation or the Insurer will take care of it ? Insurance Policy was in force at the time of accident. Kindly clarify.
