Legal Question in Real Estate Law in India

We have 1.4 acrs land. That was on my father and mother name (Not mentioned any part to any of

my parent name) document is on both name. My father expired without writting any will.

Now my mother want to sale the land.

Me one daughter married and one elder brother married.

My brother objecting to sale the land legally what action can i and my mother can do

to sale or to devide the land.

The land purchase by my father self acquired money and registered on both of my parents name.

My father expired in the year 2007.

Your brother has 1/3 rd share in your fathers share of 50% of the land. Rest 2/3 rd will go to you and your mother. Buy him out for his 1/3rd of 50% of your father share in the property.
