Legal Question in Real Estate Law in India

we are 3 brothers. there was one 10 marla house in Chandigarh which has 3 stories. my mother given each storey to three of us. we got d 1st floor. Every storey has 4 rooms. My younger brother sold out his storey and bought a new house near zirakpur. Now he has occupied one room of my storey adversely & doing business there. In second room, my mother lives & rest two rooms are with us in which we have kept our old furniture. Me & my family don't live in this house as we have our own apartment in chd itself & staying there. My other younger brother also doesn't stay in that storey which under his name. He is only doing business there. My brother who occupied one room of my floor is not ready to vacate. My mother is also with him & supporting him. According to her, my brother is poor, so I should give him either ds room or money to vacate ds room. I have the legal registry of my floor. What should I do to evict him as I can't give money to him to vacate that room. I don't want any rent or a single penny from him. Fyi...i have nevr asked him to give rent coz he occupied my property adversely. I just want him to vacate my room. For this I can give him a notice of 3 months as well. Please suggest what should I do w/t going to court?

If some wrong is committed, then only remedy is to approach a court of law with appropriate proceeding.
